11 LỖI SAI LÀM ẢNH HƯỞNG TỚI TIẾN ĐỘ RA LƯU HÀNH TBYT – MS THẢO 0368874718

IMPORTANT: Check trước khi nộp HS 4 thông tin quan trọng: 3M (model, manufacturer và made in) + chủ sở hữu (Yêu cầu khớp giữa CFS, ISO, văn bản công bố/lưu hành với tem nhãn thực tế)

Các bác đọc kỹ 11 lỗi sai dưới đây để tránh mắc phải các lỗi làm HS lưu hành bị ảnh hưởng nhé ạ. Em Thảo nhận làm trọn gói đăng ký lưu hành TBYT 0368874718 ( https://zalo.me/0368874718)

  1. Giấy tờ trong bộ hồ sơ thiếu hoặc hết hạn: CFS, LOA, ISO => check lại hiệu lực các giấy tờ trước khi nộp
  2. Không hợp pháp hóa lãnh sự 3 giấy tờ quan trọng: CFS, LOA, Bảo hành
  3. Các lỗi sai liên quan tới CFS:
    • CFS không ghi rõ “ĐƯỢC LƯU HÀNH TẠI NƯỚC SẢN XUẤT hoặc NƯỚC CHỦ SỞ HỮU hoặc nước thứ 3 cấp CFS”
    • Đây là lỗi sai cực kỳ phổ biến. 1 số CFS chỉ ghi được phép xuất khẩu mà không ghi nội dung được lưu hành hoặc được bán trên thị trường, thì CFS này 100% sẽ không được chấp nhận.
  4. Các lỗi sai liên quan tới  thư ủy quyền (LOA):
    • Sai mẫu: Mẫu mới nhất theo nghị định 98/2021, các bác nào cần thì nhắn em. Còn mẫu theo thông tư 30/2015 sẽ không dùng được nhé ạ. 1 số bác có thư ủy quyền độc quyền của hang mà không theo mẫu của BYT cũng không được chấp nhận ạ.
    • LOA không ghi ngày hết hạn: do nhiều bác bảo NCC dễ tính, uỷ quyền này họ cấp vô thời hạn nên không cần để ngày hết hanh. Lỗi này cũng bị yêu cầu làm lại LOA mới các bác nhé => Ghi rõ được cấp tới ngày tháng năm nào hoặc có thời hạn bao nhiêu năm kể từ ngày cấp
    • LOA không thể hiện đủ các mã hàng muốn xin lưu hành. Hiện vấn đề với 1 số bên có list hàng dài là không biết có phải liệt kê tất danh mục vào LOA không (trước đây khi xin GPNK thì được phép chỉ liệt kê tên hàng (không cần liệt kê model), nhưng theo như kinh nghiệm của bên em, các anh chị nên liệt kê hết vào vì làm lưu hành sẽ có 1 hội đồng chấm, nếu không may chỉ vì 1 lỗi nhỏ này mà hồ sơ không được chấp nhận phải làm lại LOA sẽ rất mất thời gian.
  5. Các lỗi liên quan tới ISO
    • Hết hạn
    • Nộp ISO 9001:2015: Lỗi này ít thôi nhưng các bác lưu ý ISO bắt buộc cho hàng TBYT là ISO 13485 nhé ạ
    • Phạm vi sản xuất kinh doanh thể hiện trên ISO không có mặt hàng đang xin lưu hành. VD đang xin lưu hành bơm tiêm điện nhưng trên ISO nhà máy không thể hiện phạm vi SX mặt hàng này thì cũng không được chấp nhận
    • Đối với sản phẩm NSX khác với CSH thì bắt buộc phải có ISO của NSX (trước đây nhiều bác chỉ cung cấp ISO của CSH)
  6. Tem nhãn sản phẩm:
    • Yêu cầu phải cung cấp cả tem nhãn gốc (label) + tem nhãn phụ khi lưu hành tại thị trường Việt Nam. Nội dung tem nhãn phụ theo quy định tại Nghị định 111/2021/NĐ-CP.
    • Lưu ý tem nhãn gốc phải thể hiện 3M: Model, Manufacturer và Made in để làm Hải quan sau này không bị phạt.
    • Nhãn gốc: Cung cấp đầy đủ mẫu nhãn của từng chủng loại sản phẩm, từng quy cách đóng gói, bao gồm cả nhãn hộp, nhãn thứ cấp của sản phẩm, nhãn chai thành phần (nếu có)…. Trường hợp đăng ký theo họ trang thiết bị y tế, được phép nộp nhãn đại diện và chỉ rõ các thông tin có thể thay đổi trên nhãn của họ trang thiết bị y tế đó.
  7. Mô tả kỹ thuật:
    • Sơ sài: Phần naỳ buộc DN phải hiểu sản phẩm của mình để điền thông tin. Anh chị có thể lấy thông tin từ catalog và IFU của sản phẩm
    • Sai mẫu: Theo thông tư 19/2021/TT-BYT, hiện đã có các mẫu MTKT tiếng việt riêng cho hàng hóa chất IVD, hàng nhập khẩu thông thường và hàng SX trong nước.
    • Đối với các hồ sơ đăng ký theo bộ/cụm/họ/hệ thống trang thiết bị y tế: Làm riêng, cụ thể các tài liệu kỹ thuật cho từng chủng loại sản phẩm, hoặc làm chung một tài liệu kỹ thuật nhưng có tham chiếu cụ thể đến trang nào hoặc tạo đường dẫn đến nội dung tương ứng với từng chủng loại sản phẩm.
    • Ghi đầy đủ thông tin, không dẫn chiếu sang các tài liệu khác (ví dụ: không ghi “Đề nghị xem hướng dẫn sử dụng kèm theo”), trừ trường hợp thông tin không thể tóm tắt được hoặc thông tin quá dài (ví dụ: phần tiền lâm sàng, lâm sàng, quy trình sản xuất, …). Nếu các tài liệu có nhiều phụ lục kèm theo, đề nghị có đề mục từng phần, chỉ dẫn rõ số trang hoặc tạo đường dẫn đến nội dung.
  8. Hướng dẫn sử dụng tiếng việt:
    • Phải có tối thiểu các thông tin sau: mục đích sử dụng/ chỉ định, chống chỉ định (nếu có), cảnh báo, biện pháp phòng ngừa, tác dụng bất lợi (nếu có), cách sử dụng, thông tin hiệu quả chẩn đoán đối với trang thiết bị y tế chẩn đoán in vitro và điều kiện bảo quản, điều kiện sử dụng để duy trì sự an toàn và hiệu quả của trang thiết bị y tế.
  9. Các lỗi sai khác
    • Up nhầm tài liệu, thiếu tài liệu
    • Quá hạn bổ sung hồ sơ nhưng quên => phải hủy làm bộ mới. Lưu ý là sẽ có 5 lần sửa đổi bổ sung hồ sơ, mỗi lần tối đa 90 ngày
  10. Về phân nhóm sản phẩm:
    • Phân sai nhóm: xem lại quy tắc phân nhóm TBYT để xem có thể phân theo Họ, hay Hệ thống hay Cụm IVD,… . Không phải cứ sản phẩm giống nhau  là có thể ghép thành 1 bộ.
  11. Khai không chuẩn về tên TBYT và model
    • Tên TBYT: Khai thông tin bằng tiếng Việt viết chữ thường (không viết hoa, không sử dụng tên tiếng Anh, tên thương mại, tên hãng hoặc đưa mã, chủng loại hoặc gộp nhiều tên trang thiết bị y tế).
    • Chủng loại:
      – Khai đầy đủ, đúng nội dung được ghi trên giấy chứng nhận lưu hành tự do và không ghi tên trang thiết bị y tế vào phần chủng loại.
      – Trường hợp có trang thiết bị y tế có nhiều chủng loại, mã sản phẩm: Đề nghị liệt kê chủng loại tương ứng với từng mã sản phẩm, quy cách đóng gói (nếu có).
